How do you manage CDL (Commercial Driver’s License) drivers with multiple employers?

The Federal Motor Carrier Safety Administration (FMCSA) has specific regulations for managing CDL drivers who work for multiple employers. Here is an overview of the classification process:

  • Drivers who hold regular employment with multiple employers
  • Drivers regularly employed by a motor carrier but occasionally drive for another motor carrier
  • Driver in a non-motor carrier who occasionally or part-time drives for a motor carrier

Drug and alcohol testing regulations

Drug and alcohol testing regulations apply to any driver operating a commercial motor vehicle (CMV) with a Gross Vehicle Weight Rating (GVWR) over 26,000 lbs, transporting 16 or more passengers, or carrying hazardous materials (HM) that require placarding.

  • Pre-employment Testing: Each employer must conduct a pre-employment drug test for all new drivers, regardless of their employment classification. This is not only a best practice but also serves as liability protection for the company, rather than relying on another motor carrier for compliance.
  • Random testing: When a driver works for multiple employers, each employer is responsible for including the driver in their own random testing pool.

All other drug testing, including post-accident, reasonable suspicion, and follow-up testing, would apply as to any other CDL driver.

FMCSA Clearinghouse regulations

Employers must comply with drug and alcohol testing regulations and maintain a driver qualification file for every driver operating a CMV. The FMCSA Clearinghouse pre-employment drug testing and query requirements apply to drivers performing any FMCSA-regulated function, as well as to each employer for whom the driver works.
