Essential Updates for CDL Drivers: Understanding FMCSA Clearinghouse-II Regulations

What is FMCSA and Why Does It Matter?

The FMCSA is a branch of the U.S. Department of Transportation that regulates the trucking industry in the United States. Its primary mission is to reduce crashes, injuries, and fatalities involving large trucks and buses. FMCSA develops and enforces data-driven regulations that balance motor carrier (truck and bus companies) safety with industry efficiency. Among its many responsibilities, the FMCSA oversees the Drug and Alcohol Clearinghouse, a national database that tracks commercial drivers’ drug and alcohol violations. 

Major Regulatory Update

On November 18, 2024, the second Clearinghouse final rule, known as Clearinghouse-II, will take effect. This rule is formally documented as Clearinghouse-II Final Rule (86 FR 55718) and builds upon the provisions set out in the first Clearinghouse final rule (81 FR 87686).

Clearinghouse-II mandates that State Driver Licensing Agencies (SDLAs) must revoke the commercial driving privileges of drivers who are in a “prohibited” status in the Clearinghouse due to unresolved drug and alcohol program violations. As a result, such drivers will see their commercial driver’s licenses (CDLs) or commercial learner’s permits (CLPs) downgraded until they successfully complete the return-to-duty (RTD) process stipulated in 49 CFR part 40, subpart O.
